I.GENERAL
The following conditions apply to all orders. Any other conditions are only binding upon us after confirmation. No clause to the contrary by the purchaser may derogate from the general conditions of sale.
Our prices are expressed in euros. This is the only currency accepted. VAT is 10% on transport services.
Our rates include unlimited insurance for passengers transported, fuel, car and driver expenses.
Only written and duly completed orders will be accepted.
II.BIDS, PRICES, INVOICING
TRANSFER :
A transfer is a journey from point A to point B.
Any transfer made between 22:00 and 07:00 will be subject to a surcharge of 20%.
The advertised rate is based on a pre-arranged trip and cannot be modified, except in the following situations, which will incur additional charges:
Any additional pick-up or drop-off will be billed at €25 excluding VAT.
Airport transfer: 1 hour’s waiting time is included in the rate for all pick-ups from commercial flights at Nice Côte d’Azur airport. 30 minutes waiting time is included in the rate for pick-ups from private flights or train stations. Beyond this time, First Trip will charge in 30-minute increments depending on the vehicle selected.
For any pick-up other than a train station or airport, any customer delay in excess of 20 minutes will be billed in 30-minute increments according to the vehicle chosen.
In the event that the customer wishes to keep the driver, we will invoice all additional hours, depending on the vehicle chosen.
Tolls are included in all transfers, unless the service results in the vehicle being made available. In this case, we may charge for any unforeseen expenses such as tolls, parking or other charges.
HOURLY SERVICE:
This is a service during which the vehicle and driver are made available to the customer.
The minimum charge is three hours. Any additional hour will be billed. Any hour started is due in full.
The advertised rate includes a flat rate of 100 kilometers. Any overrun will be billed according to the excess mileage, which varies according to the vehicle chosen.
Pick-up and drop-off times apply.
PROVISION OF A DRIVER WITHOUT A VEHICLE
This involves providing a driver, employed by First Trip, to drive the customer’s vehicle.
This service is only validated if the following documents are provided to our services:
*Copy of the vehicle registration document
*Insurance certificate
If these documents are not provided, First Trip cannot guarantee that the service will be carried out.
If the vehicle is not insured, First Trip will not be able to provide the service.
Similarly, First Trip cannot be held responsible for any damage caused to the customer’s vehicle during the service. Only the customer’s insurance can be taken into account for any claims.
LUGGAGE
First Trip declines all responsibility for lost or forgotten objects or luggage in its vehicles.
The number of pieces of luggage must be announced at the time of booking in order to establish the most suitable vehicle. Under no circumstances can First Trip be held responsible if vehicles are unable to accommodate customer luggage. Please note that for safety reasons, luggage must be placed in the trunk and not on the seats.
III. PAYMENT
GENERAL
All orders will be validated only if a credit card has been provided, together with a deposit of 50% of the Order (* see paragraph below).
Payment within 30 days of the end of the month, being the maximum term for settlement of an invoice, must be specifically requested by the customer and accepted in writing by us.
Should a payment not be made on the due date, or any other obligation of the customer not be fulfilled, the unpaid sums shall become immediately due and payable. In this case, we reserve the right to cancel any order, in which case any deposit paid will be retained by us as compensation. In addition, in accordance with article L 441-6 of the French Commercial Code, a penalty calculated on the basis of three times the legal interest rate in force, as well as a flat-rate penalty for collection costs of 40 euros, will be payable.
In the event of a change in the situation of the customer (principal or purchaser) or in the event of death, incapacity, dissolution or modification of a company, mortgaging of its buildings or pledging of its business assets, we reserve the right, even after partial execution of an order, to demand guarantees or to cancel the balance of orders transmitted by the customer.
DEPOSIT
A deposit of 50% of the transport price, including VAT, is required at the time of booking. The balance of the invoice must be paid on receipt of the final invoice. No order will be validated until the deposit has been paid.
No payment deadlines will be authorized for advance payments.
PAYMENT METHODS
The following methods of payment are accepted: bank transfer, cash, credit card (Visa, Mastercard, AMEX).
CANCELLATION OR MODIFICATION CONDITIONS
CUSTOMER-INITIATED CHANGES OR CANCELLATIONS
Any modification or cancellation must be made in writing to the person in charge of the file and will be effective after validation by our services.
Any modification having an impact on the duration and/or number of kilometers of the service, the model of vehicle or the initial program may result in an additional cost, which will be communicated to and validated by the customer.
In the event of cancellation of the service, charges will be calculated according to the following scale:
100% of the quote for cancellations 24 hours in advance,
50% of the quote for cancellations 48 hours in advance,
No charge for cancellations made more than 48 hours in advance.
In the event of no-show, the transfer will be invoiced in full.
MODIFICATION OR CANCELLATION INHERENT TO FIRST TRIP
Unless the customer requests a specific type of vehicle in writing and we agree, we reserve the right to provide a vehicle of a higher category, subject to availability. No compensation can be claimed.
In the event of interruption or change of route due to a technical problem with the vehicle, no compensation can be claimed by the customer.
In the event of force majeure, events likely to prevent the execution of the service, or impossibility not attributable to ourselves, resulting especially from disturbances in our operations, we reserve the right to cancel the service in whole or in part. This condition applies in the event of the said events occurring on the date of the service originally scheduled.
RULES
Customers are obliged to respect the equipment made available to them, i.e. the vehicle and all its accessories.
The customer may not demand that the speed limit set by French law be exceeded, or ask the driver to commit any traffic offence.
If the customer commits an offence, such as the use of narcotics, the driver has the right to immediately interrupt the rental contract: the service in progress will therefore be terminated and the entire service invoiced.
In the event of non-compliance, First Trip reserves the right to:
demand reimbursement in the event of damage to the vehicle, such as the opening of a door or other accessory.
Interrupt the passenger transport service in progress if the customer’s behavior jeopardizes the safety of the driver or the vehicle provided, or if the customer is insulting to the driver.
COMPLAINTS AND RECOURSE
Any claim for incomplete or non-conforming service must be sent to us in writing by registered letter with acknowledgement of receipt within a maximum of eight days of the service concerned.
In the event of damage to or theft of customer luggage in the vehicle by a First Trip employee, reimbursement will be made on presentation of an invoice, up to a maximum of €400 per person. Hand luggage remains the passenger’s sole responsibility and is not insured.
VII. PENALTY CLAUSE AND JURISDICTION
In the event of legal action to recover our debt, we reserve the right to claim before the court seized, as a penalty, a sum equal to 20% of the amount due in principal (with a minimum of 100euros) to take account of fees and irrepeatable costs arising from the said action.
In the event of dispute, only the Tribunal de Cannes shall have jurisdiction, even in the event of multiple defendants.
The domiciliation of bills of exchange and our acceptance of payment do not novate or derogate from this attribution of jurisdiction.
No clause to the contrary by the purchaser may derogate from this jurisdiction clause, unless accepted by us in writing.
Without return or reservation, we consider these General Terms and Conditions of Sale to have been read and approved.
